There are a few lawful reasons for a landlord to legally evict a tenant in Dubai. The most common reasons would be the tenant’s violation of the tenancy contract and the landlord’s convenience. Under reasons for breach of contract, below are the most commonly violated by the tenant:

No. The landlord needs to have the legal notice drafted by a lawyer or by someone aware of the UAE laws. This must be notarized and served to the tenant through a registered postal courier. Once served, the landlord can then send in an email (soft notice) informing the tenant that he has been served.

Dubai-based properties must go through Dubai Court Notarization and be served by a Dubai-based registered postal courier.

Yes, if the old owner did not send in the legal notice before, the new owner has now all the rights to send this. If the old owner has previously done this, the new owner is not required to send in a new one. The previous notice will still be applicable and can be pursued by the new owner upon the notice’s ending term.

The landlord should seek assistance directly from The Dubai Rental Disputes Centre (RDC) to take action. The landlord cannot independently act on it.

No. It is not possible for your landlord to evict you before your tenancy agreement is finished unless there is a serious breach of the contract (e.g. non-payment of rent, using for illegal purposes, etc.). In normal circumstances, and where there is no breach by the tenant, the landlord can request to vacate by sending a 12-month eviction notice, which must be notarized by Notary Public, and sent via registered mail. This will stand as legal proof that the tenant eviction notice was issued, and the tenant did receive it. Moreover, the reasons for eviction can be only those which are specified in the law (e.g. if the property is required for personal use, sale of property, if property requires demolishment etc). 

The tenant must receive a minimum of 12 months’ notice from the landlord to vacate the apartment at any time during the tenancy contract, provided reasons for eviction are met. The 12-month notice prior to eviction is non-negotiable. In case where there is a breach by the tenant, the landlord can ask for immediate eviction if the breach is not fixed. 

No, it is not possible for the new owner to evict a tenant before the tenancy agreement is finished and without serving a 12-month notice first. This eviction notice can be sent by the new owner either at the end of the current contract or while it is still in effect. However, there must be a valid reason for the eviction. The new owner also has the option to continue with the old (current) contract or sign a new contract with the tenant.

It is a duty of the landlord to give the tenant at least 12 months ‘ notice to vacate the property during the tenancy contract if there is no violation. RERA rules for termination of the contract are found in Articles 25 and 26 where the cases in which a landlord can evict a tenant are explicitly stated. If there is a dispute, the landlord must provide proof that the notice was legally issued and received by the tenant.
