Attestation of POA from Canada for Use in UAE

Attestation of a POA or any document from one country to use in another country often seems a nightmare, especially, if the countries are located in different continents. However, with the right approach, things can be simplified. If you are in Canada and want to issue a POA to us in UAE, you may either do it through the standard legalization which involves multiple steps or through online notarization.

Canada is a party to the Apostille Convention, but the UAE is not a party to it, therefore, the simple apostille document is not sufficient for the document to be valid in UAE. Instead, the document has to go through full authentication and legalization process. Alternatively, it has to be notarized through the UAE notaries.

Standard Legalization Process:

The legalization of a Power of Attorney or any official document issued in Canada involves following steps, to be valid in UAE:

  1. POA Preparation in English and/or Arabic: The UAE Embassy in Canada attests documents in either English or Arabic. You POA has to be drafted in in English and/or Arabic. However, if your document has been prepared in French, it has to be translated by a certified translator into English or Arabic. It is very crucial to use the correct Power of Attorney content that is acceptable in the UAE for its purpose, as redoing the document will be costly and time-consuming. The POA content that is acceptable in Canada may not necessarily be accepted in the UAE because they follow different rules and requirements.
  2. Notarization in Canada: Most official documents including Power of Attorney need to be certified by a Notary Public before taking further steps.
  3. Attestation by the Ministry of Global Affairs: Once the document is notarized, it has to be authenticated by the the Ministry of Global Affairs of Canada. At this stage the Ministry stamps the document to confirm its legitimacy.
  4. UAE Embassy Attestation: The next step in Canada is to have the document attested by the UAE Embassy in Ottawa or its Consulate in Toronto. During this stage the UAE Embassy or Consulate puts a sticker on the document, which confirms to the authorities in the UAE that the document has completed all the required steps in Canada.
  5. UAE MoFA Attestation in UAE: After the UAE Embassy / Consulate attestation, the document has to be sent to UAE and attested by the UAE Ministry of Foreign Affairs.
  6. Translation from English into Arabic: In some cases, your document may need to be translated into Arabic, especially, if the POA will be used in mainland government authorities. Free Zones may accept in English language. The translation has to be done a certified translator based in the UAE.
  7. UAE Ministry of Justice (MOJ) Attestation (if applicable): If your POA is going to be used in the court, Arabic translation and attestation by the Ministry of Justice would be required too.

The whole process of standard legalization can take 15-20 days on average.

Online Notarization:

Alternatively, instead of signing the POA in Canada and having it legalized through the above steps, you can also sign a Power of Attorney online directly with the notary public in UAE. The online notarization removes the hassle of legalization and saves a lot of time. For individuals who are currently located outside the UAE, the online notarization can be the ideal option which eliminates the need to travel and saves a lot of time.

The steps of issuing a Power of Attorney through online notary in Dubai involves following steps:

  1. Preparation of the Draft. Prior to the online notarization, the Power of Attorney has to be prepared in accordance with acceptable standards of the UAE.
  2. Collection of Documentation. Depending on the Power of Attorney, the notaries require various documents including IDs and ownership documents in relation to assets.
  3. Securing an Appointment with the Notary. Notarizing the document through online notarization requires attending a video call with original passport or Emirates ID by the person who will issue the Power of Attorney.
  4. Authentication through OTP. As part of the authentication process the person issuing a POA receives one time password to sign the POA, which serves as electronic verification. Once the documents and identities are verified, the notary public officials notarize the Power of Attorney and issue digital POA, which can be used directly in UAE without any additional attestation.
