A Power of Attorney is a legal document that allows you to appoint a person to act as your legal agent and perform certain tasks on your behalf. The agent acquires all or limited authority to make legal decisions about your vehicle, property, business, finances, or medical care.

Generally, you can appoint a family member, spouse, friend, or professionals such as lawyers or accountants through a Power of Attorney (POA) to make decisions in your absence, disability or illness.

If you are in India and want to make a Power of Attorney for using in the UAE, such POA needs to be attested. The Power of Attorney has to be attested from the concerned Ministries/Departments of India followed by UAE Embassy/Consulate in India and Ministry of Foreign Affairs in UAE.

The process of making a Power of Attorney from India to use in UAE can be divided into following steps:

  1. Drafting – First step is to get your POA drafted by experts familiar with UAE laws and requirements since the POA is going to be used in the UAE eventually. This approach will minimize the risk of POA rejection from government departments at a later stage and will save your time and money.   2. Executing a Power of Attorney – The POA needs to be printed on a Stamp paper of appropriate value (this may vary from State to State). The drafted POA should be duly signed by the grantor (person who gives the power) in the presence of two witnesses and should be duly notarized.
  3. Attestation by the concerned Ministries/Departments in India. This process involves attesting the POA from various government departments in the state of signing and by the Ministry of External Affairs (MEA) in India. There is a slight difference in the process of attesting a Personal POA vs. Commercial POA.
  4. Attestation by UAE Embassy/Consulate – It is performed by the officials of the UAE Embassy/Consulate in India. This attestation confirms that document has been legalized correctly by Indian authorities. Official sticker of UAE Embassy will be placed.
  5. Attestation by the Ministry of Foreign Affairs (MOFA) in UAE– As the last and final step, this is where the document is fully & completely verified. Another UAE official sticker will be placed. Once this step is done, your POA is ready & legal to use, unless the following step is applicable.
  6. Attestation by the Ministry of Justice (MOJ) of UAE (if applicable)– If your POA is going to be used in the court or some government departments, Arabic translation and attestation by the Ministry of Justice would be required too.
